§ 1 Scope
- (1)These general terms and conditions apply to all purchase contracts concluded between Tinycars-Schebler – sole proprietorship (hereinafter “Seller”) and its customers via the online shop or other expressly offered sales channels.
- (2)The subject of the contracts is in particular the sale of electrically powered mini vehicles (Tinycars) intended exclusively for use on private land not open to the public, and any related accessories.
- (3)The offer is aimed at both consumers within the meaning of Section 13 of the German Civil Code (BGB) and entrepreneurs within the meaning of Section 14 BGB.
- (4)Deviating terms and conditions of the customer only apply if the Seller has expressly agreed to their inclusion.
§ 2 Product characteristics and intended use
- (1)The electric mini vehicles offered by Tinycars-Schebler are not approved for use in public road traffic.
- (2)The vehicles do not have general road approval unless expressly stated otherwise in the respective product description. They are offered exclusively for use on legally permissible private areas not open to the public.
- (3)Use on public roads, pavements, cycle paths, public car parks or other traffic areas open to the public is not permitted.
- (4)Privately owned areas may also legally count as public traffic areas if they are accessible to an indefinite group of people.
- (5)Before first use, the buyer is obliged to check whether use at the intended location is permitted. The operating and safety instructions provided by the Seller must be observed.
- (6)The Seller does not guarantee subsequent road approval, the granting of an operating permit or eligibility for approval.
- (7)The specific equipment, technical performance, permissible load and other product characteristics are set out in the respective product description and the expressly agreed characteristics.
§ 3 Conclusion of contract
- (1)The presentation of products in the online shop does not constitute a binding offer, but an invitation to the customer to submit a purchase offer.
- (2)The customer can select the vehicles offered and configure them according to the available options. These include in particular exterior colour, interior, lighting and other equipment features offered.
- (3)By submitting the order with obligation to pay, the customer makes a binding purchase offer.
- (4)Receipt of the order is confirmed electronically. An automatic order confirmation does not yet constitute acceptance of the purchase offer unless it expressly declares acceptance of the contract.
- (5)The contract is concluded by an express declaration of acceptance by the Seller. For expressly offered instant payment methods, acceptance may already take place upon completion of the payment process.
- (6)The product characteristics and equipment features agreed at the time the contract is concluded are decisive for the content of the contract.
§ 4 Prices and payment terms
- (1)All prices are stated in euros and include statutory VAT where this is to be charged under tax law. If the small business regulation applies, VAT is not shown separately.
- (2)Any additional shipping, transport or other costs are shown to the customer before the order is placed.
- (3)Payment is made using the payment methods offered during the ordering process.
- (4)The purchase price is to be paid in accordance with the payment terms communicated before the contract is concluded.
- (5)If payment in advance has been agreed, the stated delivery period begins once payment has been received in full, unless otherwise agreed.
- (6)The delivered goods remain the property of the Seller until the purchase price has been paid in full.
§ 5 Delivery and shipping
- (1)Delivery is made to the delivery address provided by the customer within the delivery areas offered.
- (2)The regular delivery time for correspondingly marked products is 14 to 21 calendar days, unless a different delivery period is stated in the respective offer.
- (3)Different delivery periods may apply to individually configured vehicles. These are stated before the order is completed.
- (4)If an agreed delivery period cannot be met, the Seller will inform the customer without delay. The statutory rights in the event of delayed delivery remain unaffected.
- (5)For consumers, the risk of accidental loss or accidental deterioration of the goods generally only passes upon handover to the customer or a person authorised to receive them.
- (6)The customer is asked to document any visible transport damage with the carrier as soon as possible and to inform the Seller. Failure to report does not affect the customer's statutory claims.
§ 6 Right of withdrawal
- (1)Consumers are generally entitled to the statutory right of withdrawal for distance contracts, unless a statutory exclusion applies.
- (2)Details can be found in the separate withdrawal policy, including the model withdrawal form.
- (3)For goods that are not prefabricated and for whose manufacture an individual selection or specification by the consumer is decisive, or which are clearly tailored to the consumer's personal needs, the right of withdrawal may be excluded pursuant to Section 312g (2) No. 1 BGB.
- (4)The mere selection of a colour or equipment variant offered as standard does not automatically exclude the right of withdrawal. The statutory requirements in the individual case are decisive.
- (5)The customer's statutory rights in respect of defective goods remain in place regardless of the right of withdrawal.
§ 7 Warranty and liability for defects
- (1)The statutory rights regarding defects apply to all products.
- (2)For new goods, the regular statutory limitation period for claims for defects is generally two years from delivery.
- (3)If a product has a material defect at the time the risk passes, the buyer is entitled to the statutory claims, in particular to subsequent performance and, if the statutory requirements are met, to a price reduction, withdrawal from the contract or damages.
- (4)The lack of road approval does not constitute a material defect, provided that exclusive use on private land not open to the public has been effectively agreed as the characteristic and intended use and the goods otherwise meet the statutory requirements.
- (5)Damage caused after the risk has passed solely by improper use, unauthorised technical modifications or use contrary to the operating and safety instructions does not give rise to liability for defects, unless it is due to a defect for which the Seller is responsible.
- (6)The statutory warranty rights are not restricted by these provisions.
§ 8 Safety and use
- (1)The vehicles may only be operated in accordance with their intended use, the technical specifications and the operating and safety instructions supplied.
- (2)The buyer must in particular observe the stated age, weight, load and other usage limits.
- (3)The vehicles must not be used in public road traffic.
- (4)Modifications to safety-relevant components, in particular the brakes, steering, electrical control and battery, may only be carried out professionally.
- (5)The safety, charging and maintenance instructions provided by the manufacturer must be followed.
- (6)Statutory product safety requirements and mandatory liability provisions remain unaffected.
§ 9 Liability
- (1)The Seller is liable without limitation for intent and gross negligence and for culpably caused damage resulting from injury to life, body or health.
- (2)In the event of a slightly negligent breach of essential contractual obligations, the Seller is liable for the foreseeable damage typical of the contract. Essential contractual obligations are those whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance the customer may regularly rely.
- (3)Otherwise, liability for damage caused by slight negligence is excluded to the extent permitted by law.
- (4)Liability under the German Product Liability Act, under any guarantees given and under other mandatory statutory provisions remains unaffected.
§ 10 Final provisions
- (1)The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
- (2)For consumers whose habitual residence is outside Germany, mandatory consumer protection provisions of the state of their habitual residence remain unaffected, insofar as they apply.
- (3)For disputes with merchants and other entrepreneurs covered by law, the place of jurisdiction provided by law or separately and effectively agreed applies, insofar as permissible.
- (4)Should any provision of these general terms and conditions be or become invalid, the remaining provisions remain valid to the extent permitted by law. Invalid provisions are replaced by the statutory provisions.
